Hi everyone

Sorry I have not been on sadly it has all been so upsetting.

I have a husband who has a head injury although functions and most would not know and when Flossy went to garage I was ill.
It seems that is when the advantage was taken, we have got two stories from the man via a my husband's specialist head injury social worker.
Story one £2k of work for an MOT was outstanding, shocking when when had less than a year before spent 6k
When questioned few days later he said it was 4k owing.

There is no proof of this no communication of agreement of this to say we would have work done and I actually could of paid either price.......if I had chosen to is another story. I would of prob got another quote.

However he will not prove how much MOT was or how much he sold it for.

Even writing this I am in tears, flossy is a link between my mum and I. Plus the work of 6k was a present from my husband the last gift I had off him before his head injury. While he now appears normal to others he has lost any ability to have a relationship with me its complex.

I am so in tears I cry everytime I see a green traveller, and wake at night about it all.......only you guys will understand friends think I'm bonkers and say it is only a car......a morris can never be just a car.
I would buy her back tomorrow if I knew where she was and person would sell.

Oh dear - it seems you have been well and truly 'had'... There are some absolutely ruthless people out there who will heartlessly rip off anyone they can. It's not feasible to have 'MOT' work costing that much year after year. I really do think you need to get a solicitor and trading standards on the tail of this one.. Maybe the car should be reported as 'stolen' to the Police ?? Good luck !

If what you say is true (no offence intended, as an impartial observer I have read only your account. I do not disbelieve you, but have no way of hearing "the other side") then the garage is a despicable criminal who needs to be brought to book. With no communication (recorded delivery to your address) then in my view he had no right to take the car. He has sold it without proper title, effectively a stolen vehicle. If you are prepared to pay for the work that he has done (and have it checked VERY carefully) then he has an opportunity to buy it back from whoever he sold it to, and then return it to you. You must report this to Trading standards and also to the Police as theft of the vehicle - notify your insurance company too. Your insurance or RAC/AA cover (if applicable) may provide assistance to recover the vehicle. As the car has been stolen, the insurance will be just as keen as you to recover it. Regardless of any alleged debt, the garage cannot simply sell the car without corresponding with you, and possibly they should have gone through the small claims court.

To check the status of the car, you can enter its details on the DVLA web site - won;t tell you the owner, but will confirm whether it is registered / SORN / "taxed". Try contacting the MMOC office at Derby and asking if they have the car linked to an owner - won't tell you who, due to data protection, but again will confirm if it is in circulation. If you wrote a letter explaining the situation to the new keeper, and he/she is a member, then Derby would forward your letter on - you might be able to pay the new keeper the repair cost and get the car that way.

I understand completely the situation that has led to the delay in your update, but you must act as quickly as possible, the longer you delay, the worse it will be. Good luck.

a very sorry state of affairs,but I suspect that the garage may have tried to communicate with you regarding the ,"Outstanding debt" if there was one. To me it sounds very high,but thats garages for you .
They will have known that they can't just sell the car without first proceeding down the legal route,for recovery of the alleged debt,and no doubt if they are well established , will have done it before.(We have had to do it once or twice from my family garage) i'ts a well worn route to getting paid.
I believe The legal term is called "lien" well established in civil law. Basically pay up, or get a notice that the debt will be recoverd from the sale of the goods. However they are supposed to sell at market value,and return the surplus to you. Mind proving that could be very difficult.
If the above is the case the Police will not be interested,its a civil matter,and up to you to resolve,unfortunately.The vehicle will not be classed as stolen, You have I suspect no other option but to seak advice from a solicitor.
You need to consider the additional costs involved by him and any county court case ,and decide if you realy need to go down this route. Not what you want to hear ,but if the facts are as above then I feel extremely sorry for you,and hope you can come to a satisfactory solution. If you find the new keeper,who will now be the legal owner under the" Lien". all that he will be able to help with is how much he paid for the car,which gives you a lever against the garage for the surplus due to you.

I have read replies, it is not I am not interested

My husband's health has declined and head Injuries and the nhs do not work well together, sometimes in life you need to pick your battles.
I did log on once yes to answer a PM.
Everytime I log on it is a memory.

Flossy was a link between mum and I and her last big doing up was a birthday present from my husband the last thing he did before the accident, now he can not deal with birthdays and christmas so I don't get gifts or even a happy birthday. So you can imagin the emotional trauma when everything is combined.

I have now seen the website seems to be run by the very ill son. I have emailed expressing interest, he is not where he says he is so I can not turn up until he gives me details.
But I will meet him, little frightens I may be but we will see. I need to see proof of work. Sale etc.

We have had no contact even when I rang he would say via his staff he would ring back never did.
We have no court, no nothing.

I will try and keep you updated when I hear about the Blue car, and I will try and contact the new owner. I will one day get her back even if I have to buy her from new people. She was MOT start of this year according to DVLA

Good idea on MMC will try.

Agree with above. If you have the documentation showing ownership and paperwork showing that the vehicle was sent to the company only for repair then this is theft. You need to take legal advice asap!

How was "Minor Miracles" paid?

The financial transaction SHOULD be recorded in their business account, if the
payment can be traced back to you - thus proof of payment - will prove they
effectively sold stolen property, which is a matter for the Police.
Further investigations uncovered it was an inside job!!

I can tell you now 99.99% the police will NOT be interested, its a civil matter,I have delt with,well turned away,many similar cases when I was a Detective . You need to go to a solicitor,don't have any further communication with the garage,what you say to them Could be detrimental to you in any future Civil County court case.The vehicle will NEVER be regarded as stolen,even if you managed to get it recorded initially ,by simply reporting it as such. As soon as it was investigated it would immediately be reclassified as NO CRIME civil dispute. THat is what it is.As soon as the garage are contacted by the police they will state that there was an outstanding debt and that they were excercising their right under civil law to recover the debt,and the case would be closed as a crimial matter.
On a personal note ,I'm sure we all have the greatest of sympathy with you, you obviously have more than enough problems without all of this.
