Syntax error

I know you know about his, but I am still getting the line 1 syntax error!
when I view source line 1 is this : <!DOCTYPE HTML PUBLIC "-//W3C//DTD HTML 4.01 Transitional//EN">
It is really annoying, and it would be brilliant if it could be fixed!
